Terms of Sale

These Terms of Sale ("Terms") govern your purchase of ∆P products from Nimbus Suspensions ("we," "our," or "us"). By placing an order, you agree to these Terms.

1. Order Terms

∆P products are sold through secure Stripe Checkout. By placing an order, you agree to the following:

• Full checkout payment: Product price, included US ground shipping, any required taxes, and any promotion code adjustments are shown before payment is completed.
• Order confirmation: Stripe and/or Nimbus will send confirmation details to the email address used at checkout.
• Availability: Fulfillment timing depends on current inventory, product configuration, and hazardous-material shipping requirements.
• Cancellations: Nimbus may cancel and refund an order if we cannot fulfill it safely, legally, or accurately.

2. Pricing

Current public product pricing:

• ∆P: $849 USD (includes one pre-filled cartridge)
• ∆P Cartridge: $299 USD
• ∆P Charging Ramp: $829 USD
• ∆P Pro Components: $1,678 USD (∆P + Charging Ramp workflow)

Public prices include US ground shipping. Applicable taxes, if required, are calculated in Stripe Checkout. Public prices and offers may change before checkout is completed.

3. Payment

We accept major credit cards through Stripe. All payments are processed in US Dollars (USD). By providing payment information, you represent that you are authorized to use the payment method.

4. Shipping

• Territory: We currently ship to the continental United States (48 states) only. Due to Hazmat regulations for pressurized nitrogen, we cannot ship to Alaska, Hawaii, US territories, or international destinations at this time.
• Carrier: Orders will be shipped via a carrier certified for hazardous materials transport.
• Timeframe: Orders ship according to the current availability shown at checkout or in your order confirmation, subject to hazardous-material handling requirements.
• Risk of Loss: Risk of loss passes to you upon delivery to the carrier.

5. Hazardous Materials Notice

∆P cartridges contain pressurized nitrogen gas, classified as a hazardous material for shipping purposes. By ordering, you acknowledge:

• You will not transport cartridges via commercial aircraft
• You will store and handle cartridges according to the included safety guidelines
• You are at least 18 years of age

6. Warranty

Nimbus Suspensions warrants ∆P products against defects in materials and workmanship:

• Head Unit, Gauge, Hose: 2 years from date of delivery
• Cartridges: 2 years from date of delivery

This warranty covers manufacturing defects under normal use. It does not cover:

• Damage from misuse, abuse, or accident
• Normal wear and tear
• Modifications or repairs by unauthorized parties
• Use contrary to product instructions

7. Returns and Refunds

Before shipment: Contact us as quickly as possible if you need to cancel or correct an order. Refund eligibility depends on order status and whether fulfillment or hazardous-material handling has begun.

After delivery: If you receive a defective product, contact us within 30 days of delivery. We will repair, replace, or refund at our discretion. Return shipping for defective products will be covered by Nimbus Suspensions.

We do not accept returns for change of mind after delivery due to the hazardous-material nature of the product.

8. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the purchase price of the product
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for damages arising from misuse of the product

9. Product Use

∆P is designed for charging shock absorbers with Schrader-type nitrogen fill valves. You are responsible for:

• Ensuring compatibility with your specific shock absorbers
• Following manufacturer recommendations for your shocks
• Using appropriate safety equipment and procedures
• Compliance with local regulations regarding pressurized gases

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.
