Terms of Sale

These Terms of Sale ("Terms") govern your purchase of ∆P products from Nimbus Suspensions ("we," "our," or "us"). By placing an order, you agree to these Terms.

1. Pre-Order Terms

∆P products are currently available for pre-order. By placing a pre-order, you agree to the following:

• Deposit: A $100 USD deposit is required to reserve your position in the production queue.
• Estimated Shipping: Current estimate is Q2 2026. This is an estimate and may change based on production timelines.
• Balance Due: The remaining balance (product price minus deposit, plus applicable shipping) is due only when Nimbus decides to move to production.
• Refundable Deposit: If Nimbus does not move to production, your deposit is refunded in full.

2. Pricing

Current pricing (subject to change before final order):

• ∆P: $611 USD pre-order price (regular $879)
• ∆P Pro: $999 USD pre-order price (regular $1,699)

Prices do not include shipping. Shipping costs will be calculated based on your delivery address and added to your balance due.

3. Payment

We accept major credit cards through our payment processor, Stripe. All payments are processed in US Dollars (USD). By providing payment information, you represent that you are authorized to use the payment method.

4. Shipping

• Territory: We currently ship to the continental United States (48 states) only. Due to Hazmat regulations for pressurized nitrogen, we cannot ship to Alaska, Hawaii, US territories, or international destinations at this time.
• Carrier: Orders will be shipped via a carrier certified for hazardous materials transport.
• Timeframe: Once your balance is paid, orders typically ship within 3-5 business days.
• Risk of Loss: Risk of loss passes to you upon delivery to the carrier.

5. Hazardous Materials Notice

∆P cartridges contain pressurized nitrogen gas, classified as a hazardous material for shipping purposes. By ordering, you acknowledge:

• You will not transport cartridges via commercial aircraft
• You will store and handle cartridges according to the included safety guidelines
• You are at least 18 years of age

6. Warranty

Nimbus Suspensions warrants ∆P products against defects in materials and workmanship:

• Head Unit, Gauge, Hose: 2 years from date of delivery
• Cartridges: 1 year from date of delivery

This warranty covers manufacturing defects under normal use. It does not cover:

• Damage from misuse, abuse, or accident
• Normal wear and tear
• Modifications or repairs by unauthorized parties
• Use contrary to product instructions

7. Returns and Refunds

Pre-order deposits: Fully refundable if Nimbus does not move to production.

After delivery: If you receive a defective product, contact us within 30 days of delivery. We will repair, replace, or refund at our discretion. Return shipping for defective products will be covered by Nimbus Suspensions.

We do not accept returns for change of mind after delivery due to the hazardous materials nature of the product.

8. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the purchase price of the product
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for damages arising from misuse of the product

9. Product Use

∆P is designed for charging shock absorbers with Schrader-type nitrogen fill valves. You are responsible for:

• Ensuring compatibility with your specific shock absorbers
• Following manufacturer recommendations for your shocks
• Using appropriate safety equipment and procedures
• Compliance with local regulations regarding pressurized gases

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.
